HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

At Aveniqx Healthcare Services, we are committed to protecting the confidentiality of your medical and billing records. We are required by federal law (HIPAA) to maintain the privacy of your Protected Health Information (PHI) and to provide you with this detailed notice of our legal duties and privacy practices. We are also required to abide by the terms of the Notice of Privacy Practices currently in effect.

We may use and disclose your Protected Health Information (PHI) for the following purposes without obtaining your explicit authorization:

• Treatment: We use and disclose your PHI to coordinate and provide home healthcare services. E.g., sharing health data with your primary care physician, nurses, physical therapists, or pharmacists.
• Payment: We use and disclose your PHI to bill and collect payment for the healthcare services we deliver to you. E.g., submitting details to Medicare, Medicaid, or your private health insurance company.
• Healthcare Operations: We use and disclose your PHI to run our home healthcare agency, support business operations, and perform quality control audits of the care we provide.
• Public Health & Law Enforcement: We may disclose PHI for public health tracking, reporting abuse or neglect, reacting to FDA food recalls, or complying with court orders and law enforcement requests.

You have the following rights regarding the medical information we maintain about you:

• Inspect & Copy: You have the right to inspect and obtain an electronic or paper copy of your medical and billing records.
• Request Amendment: If you feel the medical record we have about you is incorrect or incomplete, you can submit a written request to amend the information.
• Accounting of Disclosures: You have the right to request a list (accounting) of the times we have shared your health information for reasons other than treatment, payment, or healthcare operations.
• Request Restrictions: You have the right to request a restriction or limit on the medical information we use or disclose about you. We are not required to agree to your request, except if you pay for a service fully out-of-pocket and ask us not to bill your health plan.
• Confidential Communications: You have the right to request that we contact you in a specific way (for example, home or office phone) or send mail to a different address.

Other uses and disclosures of your health information not covered by this notice or the laws that apply to us will be made only with your written authorization. Specifically, we must obtain your written authorization for the use and disclosure of psychotherapy notes, for marketing communications, or for any transaction that constitutes a sale of your PHI. You may revoke your written authorization at any time by sending a written notice to our Privacy Officer.

If you believe your privacy rights have been violated, you may file a complaint with Aveniqx Healthcare Services or directly with the Secretary of the U.S. Department of Health and Human Services (HHS) Office for Civil Rights.

All complaints must be submitted in writing. We support your right to protect the privacy of your medical information, and we will not retaliate or penalize you in any way for filing a complaint.
